These Terms & Conditions govern your use of this website and any purchases, quote requests, artwork submissions, and services provided by Red Banner (“we,” “us,” or “our”). By accessing this website, submitting a form, requesting a quote, uploading artwork, or placing an order, you agree to these Terms & Conditions.
1. Use of This Website
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the website.
You may not use this website:
- for any unlawful or fraudulent purpose
- to transmit harmful code, malware, or viruses
- to interfere with the operation or security of the website
- to submit false, misleading, or unauthorized information
- to infringe on our intellectual property rights or the rights of others
We reserve the right to refuse service, cancel orders, or restrict access to the website at our discretion.
2. Products and Services
Red Banner offers both ready-to-purchase products and custom goods and services, including quote-based work and products that may require artwork submission, proof approval, deposits, or production lead time.
All product descriptions, pricing, availability, and offerings are subject to change at any time without notice.
We make reasonable efforts to display products accurately, but we do not guarantee that colors, garment shades, thread colors, print colors, mockups, or product images will appear exactly the same on every screen or in the final physical product.
3. Orders, Quotes, and Acceptance
Submitting a quote request does not create a binding order.
A quote is not accepted and no order is final until one or more of the following occurs:
- we confirm the order in writing
- you approve an invoice
- you approve a proof or mockup when required
- you submit payment or a required deposit
We reserve the right to refuse, limit, or cancel any order or request at our discretion, including where pricing errors, product availability issues, suspected fraud, or misuse of our services may be involved.
4. Guest Checkout
At this time, Red Banner generally offers guest checkout only. You are responsible for providing accurate billing, shipping, contact, and order information so that we can process your order and communicate with you as needed.
5. Custom Orders and Artwork
For custom orders, you may be asked to submit logos, designs, text, artwork, or other materials.
By submitting any artwork or design content to us, you represent and warrant that:
- you own the content, or
- you have the legal right, license, or permission to use it and authorize us to use it for your requested project
You are solely responsible for any uploaded or submitted artwork, including any trademark, copyright, or other intellectual property issues related to that content.
We reserve the right to refuse any artwork or project for any reason, including suspected infringement, poor file quality, offensive content, or production limitations.
6. Proofs and Mockups
For custom work, we may provide a proof, mockup, design preview, or approval image before production.
It is your responsibility to review all proofs carefully, including:
- spelling
- names
- dates
- colors
- sizes
- placement
- quantities
- garment selection
- any other order details
Production may begin after your approval is received.
Once you approve a proof or mockup, you accept responsibility for the approved details. Red Banner is not responsible for errors that were present in an approved proof or mockup.
7. Deposits, Payment, and Production
We may require full payment or a deposit before beginning work on a custom order.
If a deposit is required, production, sourcing, design work, or scheduling may not begin until the deposit is received.
Unless otherwise stated in writing, deposits are non-refundable once work has begun, including design preparation, mockup creation, sourcing, setup, or production scheduling.
We reserve the right to pause, delay, or cancel work if required payments are not received.
8. Cancellations and Changes
Because many of our products are custom made or made to order, order changes and cancellations are limited.
Once a proof or mockup has been approved, or once production has begun, a custom order may not be cancelled, changed, returned, or refunded except in cases of confirmed defect, damage, or our error.
If you request a cancellation before production begins, any refund will be subject to work already performed, design time, setup time, sourcing costs, payment processing fees, and any non-recoverable costs already incurred.
9. Turnaround Times and Shipping Estimates
Any production times, completion dates, or shipping estimates we provide are estimates only.
Actual turnaround times may vary based on factors including:
- order size
- product availability
- blank supplier inventory
- proof approval timing
- complexity of the order
- shipping carrier delays
- holidays or high-volume periods
We are not responsible for delays caused by carriers, supply shortages, customer response delays, or events beyond our reasonable control.
Red Banner sells to and ships within the United States only.
10. Returns, Refunds, and Final Sale Items
Custom, personalized, made-to-order, or approved-production items are final sale unless they arrive damaged, defective, or materially different from the order as approved.
If there is an issue with your order, you must contact us within a reasonable time after delivery and provide enough information for us to review the issue, which may include photos and order details.
If we determine that an item was defective, damaged in a way covered by our policy, or incorrect due to our error, we may choose to replace, repair, refund, or otherwise resolve the issue at our discretion.
Any separate Refund Policy or Return Policy posted on this website is incorporated into these Terms & Conditions.
11. Wholesale Orders
We may offer wholesale, bulk, or business-to-business sales in addition to direct-to-consumer sales.
Wholesale terms, pricing, deposits, lead times, minimum quantities, and approval steps may vary by project. We reserve the right to set different requirements for wholesale orders.
12. Pricing Errors and Availability
We try to keep pricing and availability accurate, but errors may occur.
We reserve the right to correct any pricing, listing, description, shipping, or availability errors and to cancel or refuse any order placed using incorrect information, including after submission.
If an order is cancelled after payment due to an error, we will issue an appropriate refund of the amount paid for the cancelled portion.
13. Intellectual Property
All content on this website, including text, graphics, branding, logos, images, designs, and other material created by or for Red Banner, is owned by or licensed to Red Banner and may not be copied, reproduced, distributed, modified, or used without prior written permission.
This section does not claim ownership of customer-submitted artwork. Customer-submitted content remains subject to the rights of its original owner, and you are responsible for having permission to use it.
14. Third-Party Tools and Links
This website may use or link to third-party services, platforms, plugins, or websites. We are not responsible for the content, policies, availability, or practices of third-party services.
Your use of those third-party services is at your own risk and subject to their terms and policies.
